Job Purpose

The Compliance Officer (CO) & Money Laundering Reporting Officer (MLRO) will be responsible for supporting the Country Manager – Asia (CM-A) and Director of Compliance (DoC) in overseeing the Compliance Function and exercising Compliance and Risk Oversight and Money Laundering as defined by the AMLO rules in Hong Kong.

This will include being an expert within the business on all Compliance and Financial Crime Matters, ensuring the business is clear in understanding its responsibilities and obligations under relevant Compliance and Risk policies, keeping the DoC and CM-A fully informed regarding developments in Compliance, regulation, rules, and standards that may affect the business, and nurturing a culture of compliance throughout the company.

Duties/Responsibilities

  • Perform CO & MLRO responsibilities, including external reporting to regulators and industry body such as suspicious activity reports
  • Assist the DoC in creating, reviewing, and updating practical procedures for Compliance and Risk policies, specifically those relating to AML, Customer Due Diligence, Data Protection, and Compliance to local regulations and legislation, guidance, and industry standards
  • Support with regulatory issues, discussing promptly with the CM-A and DoC any Compliance or regulatory issues arising in the business, and report the issue in the appropriate log, agreeing to the corrective action to be taken including responsibility, timelines, and review date
  • Support in routinely stress testing and monitoring the business Compliance and Risk
  • Support in monitoring, reviewing, and updating the internal company risk appetite considering all relevant factors including but not limited to the Senior Leadership Team and the Board, banking partners, country risk ratings, and industry appetite
  • Ensure the annual Compliance Monitoring Plan is adhered to
  • Liaise and collaborate with local regulators to fulfil any regulatory requirements
  • Collate and report MI to the CM-A and DoC
  • Ensure the Compliance Registers are complete, accurate, and effective
  • Maintain complaints oversight and response
  • Assist the DoC in reviewing and updating the risk matrix
  • Create, review, update, and deliver routine and ad hoc compliance and AML training for the business
  • Ensure effective Horizon monitoring to pre-empt emerging compliance issues and hotspots
  • Assist and on occasion onboard (if required) low, medium, and high-risk FX and Investment Clients, ensuring Anti-Money Laundering (AML) legislation and Customer Due Diligence requirements are met
  • Complete Source of Wealth and peer reviews for corporates and individuals when required
  • Complete and oversee quality assurance checks, ensuring that all regulatory requirements are in place
  • Review and approve financial promotions
  • Ensure AML transaction monitoring solutions are adhered to, including the sanctioned payments review and transaction monitoring
  • Assist in ensuring that Compliance procedures and controls remain current and reflect industry practices, responding to queries from the business on the interpretation of relevant Compliance and Risk policies
  • Stay aware and knowledgeable of industry best practices and all regulatory Compliance and Risk changes
  • Nurture a culture of Compliance and Treating Customers Fairly throughout the company
  • Carry out any further tasks for which the qualifications and experience of Compliance Manager & MRLO are suited, including other duties as assigned by the CM-A and/or DoC to assist Compliance Function with the completion of workload and projects
  • Respond to ad hoc query reviews in a timely and professional manner
  • Accountable for understanding Consumer Duty policy and procedures; partner and collaborate within the team to achieve set standards

Qualification & Experience

  • University degree or higher preferred (BA/BS) with a focus/specialization in Law, Finance or Compliance related disciplines
  • 6+ years overall compliance experience
  • 3+ years’ proven experience in a senior-level Compliance or Risk advisory role either for a financial services company or retail bank
  • Money Service Operator (MSO) experience is considered an advantage
  • MLRO experience is seen in a very preferential light
  • Have experience working in a Compliance, Risk and/or Anti-Money Laundering function
  • Ability to communicate cross-functionally and build a culture of compliance
  • Be able to build trusting and collaborative relationships across the business and with external suppliers
  • Have an excellent understanding of the requirements of MSO’s in Hong Kong
  • Ability to pass Fit & Proper assessment with Customs & Excise
  • Possess excellent written and verbal communication skills and be able to communicate at all levels
  • Have excellent stakeholder management skills, with the confidence to challenge supportively and effectively where appropriate and at all levels
  • Demonstrate strong time management and delegation skills with the proven ability to manage multiple projects effectively
  • Proficiency in written and spoken of English and Cantonese, Mandarin is a plus
